CHILD CUSTODY



Usually in a divorce or separation situation, it is the court's determination of which parent, relative or other responsible adult should have physical and/or legal control and responsibility for a minor child.  While a divorce proceedings is pending, the court may award temporary custody before making a final ruling.

There is a difference between physical and legal custody of a minor child.  Physical custody designates where the child(ren) will actually live.  Legal custody gives the custodial parent the right to make decisions regarding the child(ren)'s welfare.  In some cases, where the parents are amicable, Joint physical and/or legal custody may be awarded.

In most states, the court holds jurisdiction over the custody of the child(ren) and can change the arrangements if circumstances warrant.
