COMMUNITY PROPERTY
Property and earnings that a couple has acquired during their marriage
is defined as community property. Also, all debts incurred during
the marriage are considered community property debts. In most
states, in order for equitable distribution to occur, community property
and separate property must be established.
Community property recognizes the equal contribution of both parties to
the marriage even though one of the parties may earn more income through
employment or other means.
