FAULT DIVORCE
A basis for a divorce to be granted which requires on spouse to prove that
the other was legally "at fault". Ultimately, the "innocent" spouse
would be granted a divorce from the "guilty" spouse based on his/her
actions and/or behaviors. Most states still allow a spouse to allege
fault in obtaining a divorce. Traditionally, the fault grounds for
divorce include adultery, cruelty, desertion, incarceration, physical
incapacity and incurable insanity.
