MEDIATION



A dispute resolution method designed to help parties resolve their disputes without going into court.  A married couple seeks the active participation of a third party, mediator, who will work with the couple to find points of agreement in order to reach a result that is fair and equitable to both sides.  In situations involving divorce and separation, mediation sessions will usually include topics such as child custody, visitation schedules, child support, alimony, distribution of property, etc.

Mediation differs from arbitration as to the arbitrator acts much like a judge in an "out of court" setting but still imposes a resolution to the situation.  A mediator has no power to impose a solution.  The parties are encouraged and guided by the mediator to come to a solution for themselves.
