Arkansas child support law is governed directly by
Federal mandates. The Federal Law Government has
implemented laws and regulations that require that
Arkansas issue support guidelines so that Arkansas
can continue
to receive Federal Funding. The Arkansas
child support laws are based upon Federal
research that identifies the amount of support provided to children in intact
families at different income levels. As a result,
child support in Arkansas, like every other state, is
supposed to provide all children with the same level of
support that they would have had if the parents had not
separated or divorced. Arkansas also has specific
laws on support collection and enforcement as a result
of the Federal laws and guidelines.
Arkansas child support has a written set of guidelines
that are used for the calculation of child support. The
amount arrived at by applying the guidelines is
presumptively correct unless it is determined by the
Court that the amount is unjust or inappropriate.
Arkansas child support can be deemed unjust or
inappropriate by the Court using five main factors.
These include any necessary medical, dental or
psychological care or insurance, as well as day care
expenses. If there is a creation or necessary
maintenance of a trust fund for the child or any
additional support provided by the parent obligated to
pay support. As well as, an extraordinary time spent
with the non-custodial parent.
Arkansas terminates support upon the child's 18th
birthday or when the child graduates from high school.
Parents cannot be ordered to pay for their child's
college education.
