Colorado child support, support collection and support
enforcement laws are all based upon dictates from the
Federal Government. To maintain its right to
Federal funding, Colorado must maintain these support
laws. The Federal dictates resulted from
substantial research that determined the level of
support provided to children in intact families.
It is the Federal intent to maintain that same level of
support for children in families that are not intact.
Given the Federal mandates, support laws are not
significantly different from state to state.
Colorado child support is determined using written
guidelines. The Court may order reasonable and necessary
support base on factors including the financial
resources of the child and those of the custodial and
non-custodial parents. Also, to ensure that the standard
of living the child would have enjoyed if the marriage
had not been dissolved is comparable as well as the
physical and emotional conditions and educational needs
of the child are met.
Colorado child support may also involve the addition of
medical insurance coverage. Parents cannot be compelled
to pay for the college education of their children.
Colorado child support Orders entered on or after July
1, 1997, child support terminates with the child attains
the age of 19, unless one or more of the following
conditions exist: (1) the parties agree otherwise in a
written stipulation after July 1, 1997; (2) a child is
mentally or physically disabled and the Court orders
child support to continue beyond the age of 19; and (3)
if a child is still in high school or an equivalent
program. When a child is in high school or an equivalent
program, child support will continue until the end of
the month following graduation.
