Delaware child support is directly impacted by Federal Law.  The Federal Government has passed various laws and regulations over the past fifteen plus years that require Delaware, and all of the other states, to implement and maintain laws pertaining to child support, support enforcement, and support collection.  If a state does not maintain those laws, it is not eligible for Federal aid under certain Federal programs.  The Federal mandates are based upon research regarding the support provided for children in intact families at certain income levels.  The objective of the Federal law is to maintain that same level of support for children if their parents separate or divorce.

Delaware child support will be established using certain factors. The financial resources of the child along with the relative financial means, the amount and sources of income of each parent is taken into account when determining the appropriate amount of support. The age, health and station each parent and the child is also considered.

Support in Delaware will also be determined using the standard of living that the child would have enjoyed if there had been no divorce is also an important factor when the Court determines child support.
