Hawaii child support law, is directly governed by Federal Law.  Indeed, the laws pertaining to support, support collection, and support enforcement in all of the states have been passed as a direct result of Federal mandates.  The Federal Government has passed various laws over the past fifteen plus years requiring adherence to the Federal support laws as a condition to the states receiving certain Federal aid.  The Federal mandates resulted from substantial body of research pertaining to the amount of support provided to children in intact families at different income levels.  The state support laws are supposed to continue to provide that support level to children of divorced or separated families.

Hawaii child support is determined by State guidelines. In Hawaii, the Court may order either or both parents to provide child support in a "just and equitable manner", and the Court can deviate from the guidelines.  If the parents are unable to agree on an amount of child support, the Court will apply the guidelines to determine the amount of child support to be paid. Like most State guidelines, in Hawaii, the amount of child support will be a percentage of the support payor’s income. The percentage of income which a parent will have to pay will increase based upon the number of children at issue. The Court will only apply the guidelines if the parents cannot reach an agreement.

Hawaii child support will take into consideration a number of  factors.  Specifically, the Court will consider the relative merits of the parties, the relative abilities of the parties the condition of the parties after the divorce, and the burdens imposed on the parties for the benefit of the child.  All other circumstances of the case can also be used by the Court while considering equitable child support.

Hawaii child support payments will generally terminate upon the child’s eighteenth (18th) birthday. However, child support payments may continue if a child is disabled or attending college on a full time basis. Support may end earlier than the child’s eighteenth birthday if the Court determines that the circumstances warrant such a result.
