Kansas child support is actually based upon, or directed by Federal Law.  The Federal Government undertook studies to determine how much support was available to children in intact families at different income levels.  The Federal Government then passed laws that would deny Federal funding to any state that did not pass child support laws that incorporated the Federal guidelines.  As a result, every state has a support law scheme that conforms to the Federal mandates.  The support collection and support enforcement laws in Kansas, as well as the other states is also dictated by Federal Law on those topics.

Kansas child support may be assessed against either or both parents. Kansas has specific state guidelines for the calculation of child support. In calculating child support, the Court will consider the guidelines and the following factors: (1) the financial resources of the child; (2) the physical and emotional conditions and educational needs of the child; and (3) the financial resources, needs, and obligations of both the noncustodial and the custodial parent.

Kansas child support payments generally continue until the child’s 18th birthday or June 30 of the school year in which the child reaches the age of 18. A parent can request that child support be extended through the school year during which the child reaches the age of 19 so long as the child is a bona fide high school student and the parents jointly participated in or knowingly acquiesced in the decision which delayed the graduation of the child from high school.

Kansas child support payments are paid to the Clerk of the Court or to the Court Trustee unless the Court orders otherwise. The Trustee has the power to enforce child support orders. To further aid in the collection of child support, Kansas support orders contain provisions for income withholding orders. An income withholding order will be prepared by the Court Trustee and served on the support payor’s employer. Once issued, the Order will allow for the deduction of the child support payments from the support payor’s income.
