Kentucky child support is governed by Federal Law.  In fact, support laws in all states have been promulgated as a result of Federal dictates.  The Federal Government compels the various states to pass certain laws regarding child support.  For Kentucky to continue to receive Federal Funding, Kentucky has to comply with those Federal laws.   The state laws, including the Kentucky support statutes, are based upon research that shows how much  support is available to children in intact families at different income levels.  The Federal laws also govern the support collection and enforcement laws in the various states.

Kentucky child support is based upon official child support guidelines. The amount of support arrived at under the guidelines is presumed to be correct but may be adjusted based upon certain factors.

In Kentucky, the Court may deviate from the official child support guidelines after considering any extraordinary medial, dental, educational, job training or special needs of the child as well as those of the parents. Independent financial resources of the child as well as the combined parental income in excess of the support guideline amount are considered in the determination of support.

A Kentucky Court will also entertain any child support agreement between the parents on, provided that no public assistance is being provided as well as any other extraordinary circumstance.
