Maine child support is based upon official child support guidelines. The amount of support arrived at under the guidelines is presumed to be correct unless it is shown that the amount is unjust, inappropriate or not in the best interests of the child.

Official child support guidelines in Maine are mandated by Federal Law and must be adhered to for Maine to receive Federal aid under certain Federal programs.  The Federal Laws also mandate that Maine pass specific laws on support collection and support enforcement. 

Maine child support may deviate from the official guidelines if the Court considers a number of factors. The financial resources, physical and emotional condition and the educational needs of the child as well as the financial resources and needs of each parent, including any nonrecurring income not included in the definition of gross income may be considered by the Court. The Court may also deviate from the guidelines after considering the standard of living the child would have had if the marriage had continued, additional income and financial contributions of a spouse of each parent, the tax consequences of a support award, the cost of transportation of any child, and any inflation in relation to the cost of living along with any other dependents of the parent required to pay support. The Court may also consider any child support, spousal support, and property division that is being decided at the same time.

Maine child support amount may also deviate from the guidelines after the Court looks at the number of children requiring support is over six or if the non-primary residential caretaker is providing residential care over 30% of the time and if any of the children are over 12 years of age. If health insurance premiums are over 15% of the support award the Court may deem it necessary to deviate from the official guidelines.
