Maryland child support is calculated using a set of guidelines used by the Courts. The amount of child support arrived at under the guidelines will be presumed to be correct unless it is shown that the amount of support calculated is unjust or inappropriate. The Court may modify the amount of support by considering a number of factors.

Maryland child support may be modified if the Court considers the terms of any marital settlement agreement between the parents, including any provisions for payments of marital debts, mortgages, college education expenses, the right to occupy the family home and any other financial terms. The Court may also consider the presence in the household of either parent of other children that the parent has a duty to support.

Child support, support enforcement and collection laws in Maryland are based upon Federal laws.  If Maryland does not comply with those Federal Laws, it will lose Federal funding under certain Federal programs.  All states have passed laws complying with the Federal mandates as a result.   The Federal mandates are intended to provide uniform support for children based upon the amount of support that children in intact families receive.
