Minnesota child support is based upon guidelines that assist the Court in calculating the appropriate amount of child support. In determining child support, a Court will consider the financial resources of the child as well as the custodial parent along with the standard of living the child would have enjoyed if the marriage had not been dissoved. The Court will also consider the physical and emotional conditions and educational needs of the child. The tax consequences of the payment of support along with the amount of public aid received by the child is also considered in assessing child support payments.

Minnesota child support may also deviate from the guidelines by considering any debt of the parents. However, marital fault or misconduct is not a factor when the Court is considering an appropriate child support amount.

Child support in Minnesota has been based on Federal Law for more than fifteen years.  The Federal Government began to limit Federal funding to states that did not implement support laws, including support collection and support enforcement laws, that complied with certain Federal mandates.  The Federal mandates are designed to maintain children at the same support level that they enjoyed while their family was intact if their family divides.
