Missouri child support laws are based upon Federal Laws that require all states to maintain certain support statutes or risk losing Federal aid. The Federal provisions also govern how the states address issues such as support collection and support enforcement.  All states have complied with the Federal mandates.  Those mandates have been in effect for fifteen plus years and are themselves based upon research that shows how much support children in intact families receive.  The Federal objective is to maintain the same level of support for children in families that are not intact.

Missouri child support is calculated based upon official guidelines. The amount of child support arrived at under the guidelines is presumed to be correct unless such an amount is shown to be unjust or inappropriate.

Missouri child support amounts may deviate away from the guidelines if the Court determines the amount to be unjust or inappropriate after considering certain factors. The Court will look at the financial resources, physical and emotion conditions and educational needs of the child as well as those of both the non-custodial and custodial parents. The Court will also consider the standard of living the child would have enjoyed if the marriage had not been dissolved. The father's primary responsibility for the support of his child is also considered while determining the appropriate amount of child support.
