Montana child support is based upon uniform guidelines. To assist the Court in determining the appropriate amount of child support, certain factors maybe be considered. The Court may look at the financial resources, physical and emotional conditions and the educational and medical needs of the child along with the financial resources, needs and obligations of both the non-custodial and the custodial parent. The age of the child as well as any cost of day care or parenting plan implemented for the child may also be considered by the Court. The Court may also factor in the standard of living the child would have enjoyed if the marriage had not been dissolved along with the needs of any other person that a parent is obligated to support. The Court may also include a provision for health and medical insurance for the child.

Child support laws as well as support enforcement and support collection in Montana, are mandated by Federal law.  To receive Federal funding,  Montana must comply with those laws.  The Federal laws are designed to provide uniform support nationwide for children in families that have separated or divorced and to provide a level of support that is similar to what they would have received if their family remained intact.
