New Jersey child support is based upon guidelines for the calculation of child support. There are certain other factors the Court may entertain is awarding child support. The financial resources, needs, obligations, and standard of living and economic circumstances of both the non-custodial and the custodial parent along with the needs of the child may be considered by the Court.

New Jersey child support may deviate from the guidelines if the Court takes the age and health station of the child and the parents into consideration, along with the responsibility of the parent for the support of others as well as the earning ability of each parent, including education background, training, employment skills, work experience, custodial responsibility for the child, costs of child care and the length and cost of education and training to obtain employment.

New Jersey child support, is actually based upon Federal Law.  The Federal Government has directed the laws in the areas of support, support collection and support enforcement for many years.  Any state that does not comply with the Federal guidelines will lose Federal funding under specific programs.  The Federal Government guidelines are based upon  the level of support that is available to children in intact families at different income levels.
