New Mexico child support, support enforcement and support collection laws are based upon Federal law.  The Federal Government has undertaken studies regarding the support provided to children in intact families and mandates that all states maintain laws that provide a similar level of support to children of divorced or separated families.  If New Mexico child support laws do not comply with Federal requirements, Federal aid will be withheld under certain programs.

New Mexico support is based upon guidelines and worksheets. Separate worksheets are provided for determining child support amounts for parents with visitation and for parents with shared responsibility. Shared responsibility or joint custody is defined as each parent having the child in their home at least 35% of the time during the year.

New Mexico support guidelines are presumed to be correct unless there is showing that the amount of support would be unjust or inappropriate. The Court may look at any extraordinary uninsured medical, dental, or counseling expenses for the child of over $100.00 per year as well as any extraordinary education expenses for the child or transportation and communication expenses for long-distance visitation or time sharing. A substantial hardship for either parent or the child may also justify an adjustment of the amount of the child support payment.
