North Carolina child support is based upon Federal mandates and guidelines.  Every state must maintain support, support enforcement and support collection laws as directed by the Federal Government, or lose Federal funding under certain programs.  The Federal laws are based upon research that outlines how much support is provided in intact families to children.  The Federal intent is to maintain that support level when parents divorce or separate. 

North Carolina child support is based upon official guidelines which are presumed to be correct, unless it is shown that the amount derived at is unjust or inappropriate. The Court can consider a number of factors when determining the appropriate amount of support. The needs, earnings, conditions and accustomed standard of living of the child may be taken into consideration by the Court. Any types of other support provided to the child, such as a residence, payment of a mortgage, payment of medical expenses, provisions for health insurance, or lump sum payments may also be cause for the Court to deviate from the official guidelines.

North Carolina child support amounts may also deviate from the official guidelines if the Court chooses to consider the parents' ability to pay, any special needs or expenses of the parents', the child care and homemaker contributions of each parent, and a parent's prior child support or alimony obligations along with any other relevant factors.
